These are the conditions for reading and using this website, which belongs to Affinity Search Partners. They are short by the standards of such documents, and each topic below is meant to make sense on its own. How we handle information is covered separately in the privacy policy.
What these terms cover
These terms set out how you may use this site and the pages on it. Opening the site and reading it counts as agreement to them. Anyone who does not accept them should simply leave the site.
"We", "us" and "our" mean Affinity Search Partners, a recruiting firm whose office is at 5123 Virginia Way, Suite A23, Brentwood, TN 37027. "You" means whoever is reading, whether on your own account or for an employer.
What this site is
The site describes the recruiting work we do: placing contractors, people on contract-to-hire terms, permanent staff and technology leaders in IT and information systems roles. It exists to explain that work and to give you a way to reach us.
No page here amounts to an offer, a quotation or a commitment to run a search. An engagement between you and us comes into being only through a signed written agreement, and should that agreement and this site ever disagree, the agreement wins.
Emails we send to businesses
We may write to people in business roles connected with recruiting and technical hiring: those who take on technical staff, and those who work in the kinds of roles we fill. Such messages come from this domain and from our other domains.
Replying to any of them and asking us to stop is enough to end them. The information behind those emails, and the stop list that keeps you off future outreach, are explained in the privacy policy.
Samples on this site
The diagram on the home page, and any board, chart, checklist or figure that appears here or within a linked sample document, is an illustration built from sample data to show how something might look.
A sample is not the result of any client engagement, describes no particular company, and promises nothing about how a search will turn out. Treat it as a picture, not as evidence.
Using the site responsibly
Use the site lawfully and leave it working for everyone else. Do not try to disrupt it, break into any part of it or the systems behind it without authorization, or test it for weaknesses.
Automated copying, scraping and harvesting of the content are not permitted. Reading the pages, printing them and linking to them are all welcome.
Who owns the content
Everything on the site, from the writing to the drawings, the logo and the layout, belongs either to Affinity Search Partners or to licensors who allow us to use it. Our name and logo may not be used without written permission from us.
Viewing the pages and printing them for your own business reference is permitted. Anything beyond that, whether copying, distributing or reusing the material, needs our consent. Rights in work done for a client are fixed by the written agreement for that engagement rather than by these terms.
Links and the font service
The links on this site go to our main website and its contact form, and the pages pull their typeface from an outside font provider. We control none of those sites or services and are not answerable for their content or for the way they treat your data.
Their own terms and privacy practices govern your use of them.
No warranties
We offer the site "as is" and "as available". To whatever extent the law lets us, we make no warranty of any kind, stated or implied. That includes the implied warranties concerning merchantability, concerning fitness for a particular purpose and concerning non-infringement, and it includes any suggestion that the pages are accurate, uninterrupted or free of mistakes.
What you read here is general information about our services. It is not advice of a professional, legal, financial or employment kind, and it should not be treated as if it were.
Limits on what we owe
Wherever the law allows it, Affinity Search Partners accepts no liability for damages that are indirect, incidental, special, consequential or punitive, nor for lost profits, lost revenue, lost data or lost opportunities, whatever their cause, arising from your use of the site.
Add up every claim connected with the site and our total liability still cannot exceed one hundred US dollars. If your jurisdiction refuses to enforce a cap of this kind, that sentence does not apply to you.
Your responsibility for misuse
Misusing the site or breaking these terms makes you responsible for the consequences. You agree to indemnify Affinity Search Partners and hold us harmless against the claims, losses, damages and costs that follow, including reasonable attorneys' fees.
That covers claims brought by third parties as well as costs we bear directly.
Tennessee law and arbitration
Tennessee law governs these terms and every disagreement about the site, specifically the laws of the State of Tennessee, leaving aside its rules on conflict of laws.
A disagreement that conversation cannot settle goes to binding arbitration. The arbitration takes place in Williamson County, Tennessee, and follows the rules of the American Arbitration Association. The arbitrator's award is final and may be entered as a judgment by a court that has jurisdiction. Should the law bar arbitration of a particular claim, that claim is heard by the state or federal courts serving Williamson County, Tennessee, and you accept their jurisdiction.
The rest of the fine print
Should a court find one clause unenforceable, the remaining clauses carry on. Letting a breach pass once does not waive our right to act on the next.
Together with the privacy policy, these terms are the whole of the agreement covering this site. They may be revised from time to time; the date beside the title shows which version is in force, and using the site after a revision means you accept it.
